DACA (Deferred Action for Childhood Arrivals)

The Secretary of Home Security announced on June 15, 2012, that certain persons who arrive at the U.S. as children may request “consideration of deferred action for a period of two years, subject to renewal.” Deferred action does not grant lawful status but does protect the person from removal action for a specified period.

You may be eligible for DACA if you were:

• Under the age of 31 as of June 15, 2012;
• Came to the U.S. before your 16th birthday;
• Have resided in the U.S. since June 15, 2007, to the present time;
• Are in school or have graduated, or have received a general education development certificate;
• Have not been convicted of a felony or significant misdemeanors (e.g., domestic violence, sexual abuse, drug trafficking, driving under the influence) and do not pose a threat to U.S. national security.

The procedures for filing and the documents you need to submit are many (examples include proof of identity, proof of arrival to the U.S. before 16th birthday, proof of immigration status). Collecting this evidence and making sure everything is in order is, for many, overwhelming and confusing.

Once we submit the evidence and forms, we will receive a written notice of the decision by mail. If USCIS does not grant DACA in your case, you are not able to appeal the decision or file a motion to reconsider.
